T-Mobile's Appeal Against Misleading Ad Claim Decision

Source: Date:

T-Mobile has decided to appeal a recent ruling from the National Advertising Division (NAD) regarding the validity of their claims in an advertisement. The NAD found that T-Mobile should cease making certain assertions about the potential savings customers could achieve by switching from another provider, particularly Verizon. The NAD scrutinized various materials and commercials where T-Mobile made the claim of saving 20% by switching from Verizon.

Despite T-Mobile's assertion that they had already modified the ads to include information about additional perks like free streaming services, the NAD determined that the primary message remained misleading. The NAD concluded that customers may mistakenly believe that the savings were solely based on lower plan prices, without considering the added benefits. T-Mobile's revised fine print failed to clarify essential details about the savings claim, potentially causing confusion among consumers.

As a result of the ruling, T-Mobile has been directed to discontinue using the 20% savings claim in their advertising. However, T-Mobile disagrees with the decision and intends to escalate the matter to the National Advertising Review Board (NARB) for further review.
