Charter argued that Spectrum should be recognized as a key competitor in the mobile service industry, suggesting that T-Mobile's claim was misleading.
While the NAD found that the claim might not hold if Spectrum is deemed a "big player," the NARB has now overturned that ruling. In its review, the NARB emphasized that the major competitors in the mobile space are Verizon, T-Mobile, and AT&T, based on market share, and thus declared T-Mobile's advertising claim as substantiated. The NARB pointed out that consumers can verify potential savings using a dedicated calculator on T-Mobile's website, affirming the legitimacy of the advertised savings.
